Terms & Conditions

The following terms shall have the meanings detailed below when used in these Terms and Conditions.

“Client” means the person or organisation responsible for placing the booking and/or responsible for payment of the hire charges.

“Hire” means the period for which a vehicle has been hired or reserved.

“Passenger” means the person or persons in the travel party during the period of hire contracted by the Client.

“Chauffeur” means the driver of the vehicle.

“Force Majeure” means any circumstances or events which are unusual and/or unforeseeable which are beyond the control of Top Calibre, the consequence of which could not have been avoided even if all due care had been exercised, including (but not limited to) war or threat of war; riot; civil strife; hostilities; political unrest; government action (local or national); industrial dispute; natural or other disaster; nuclear incident; terrorist activity; weather conditions; closure of roads, toll roads, road bridges, ferries, airports, rail networks or other transport delays; vehicle breakdown; punctures; congestion delays; fire; flood; drought; re-scheduling or cancellation of journeys due to technical problems with transportation that are outside our control.

  1. Top Calibre is a licensed operator and complies with the appropriate provisions of the Local Government (Miscellaneous Provisions) Act 1976 relating to Private Hire Vehicle operations and activities. Top Calibre has full private hire vehicle insurance. Top Calibre vehicles will not carry more passengers than licensing or insurance permits.
  2. Hire Charges are payable in advance unless agreed otherwise and in any event are payable within 14 days of booking completion. Top Calibre reserves the right to correct errors in both advertised and confirmed charges and will do so as soon as possible after becoming aware of such errors.
  3. Variations to original journey bookings and agreed to between Top Calibre and the Client may result in additional hire charges if the changes involve additional mileage and/or time.
  4. In accordance with current legislation vehicle passengers are required to wear seat belts unless subject to medical exemption from compulsory seat belt wearing in which event a current valid Certificate of Exemption must be shown to the Chauffeur prior to commencement of travel. Top Calibre does not provide appropriate child restraints for children under 3 years of age or for children aged 3 to 11 and under 1.5 metres (about 5 feet) in height. It is the responsibility of the Client and/or Passengers to ensure that such children are provided with appropriate restraint. Failure of the Client and/or Passengers to wear seat belts and/or children to be suitably restrained may result in cancellation of the Hire prior to journey commencement or at any other time during the Hire period and in the case of either event Top Calibre will not be liable for alternative travel costs for the Client and/or Passengers nor will any refund of hire charges be made.
  5. Passenger luggage of reasonable amount and weight is anticipated, but luggage which in the opinion of the Chauffeur is excessive by weight or size will not be carried. It is the responsibility of the Client to ensure that an excess luggage issue does not arise.
  6. Top Calibre may decline any Hire without providing reason or explanation.
  7. Damage to the vehicle, interior (including soiling) or exterior, during a period of hire will be the responsibility of the Client if caused by: the Client, Passengers, guests of the Client or any members of the Client’s party, howsoever caused including incitement or behaviour resulting in damage to the vehicle or contents by a third party in which event the Client will be liable for the cost of vehicle repair and consequential losses. The Client shall also be liable for any further losses incurred as a result of lost bookings.
  8. Passengers will be refused travel if the Chauffeur becomes aware of drug, alcohol, or solvent abuse prior to or during a period of hire in the event of which Top Calibre will not be liable for alternative travel costs for the Client and/or Passengers nor will refunds be made in respect of hire charges.
  9. Top Calibre accepts no liability for loss, damage or theft to luggage, property or personal effects carried in vehicles.
  10. Top Calibre maintains a strict non-smoking policy in all vehicles and does not permit the consumption of alcohol or food in vehicles. Failure to adhere to this policy will result in immediate termination of Hire and no refund of hire charges will be made and the Client will be charged for any valet costs and any other damage caused.
  11. Journey travel timings are reasonable estimates and Top Calibre accepts no responsibility for any delays howsoever caused (Force Majeure). Top Calibre does provide guidance for travel timings but it is the responsibility of the Client to ensure that there is adequate time allowed for travel to and from destinations.
  12. If in the opinion of Top Calibre or the Chauffeur adverse weather conditions may place the safety of the Client, Passengers, the Chauffeur or the Vehicle at risk then Top Calibre or the Chauffeur may cancel the Hire in full or in part. The liability of Top Calibre in such circumstances shall be restricted to a refund of the Hire Charge if the Hire has not commenced or based on a percentage of the Hire Charge if the Hire journey has commenced, such partial refund to be determined by Top Calibre.
  13. Top Calibre reserves the right to substitute a vehicle at any time should the original hire vehicle be unavailable due to circumstances beyond our control (Force Majeure). Where a substitute vehicle is of a lesser specification an appropriate hire charge adjustment may be made in favour of the Client.
  14. Top Calibre forbids persons other than their own Chauffeurs from driving their vehicles.
  15. Top Calibre reserves the right to use subcontract vehicles and chauffeurs when required.
  16. Pets are not permitted in Company vehicles.
  17. Top Calibre reserves the right to refuse travel to persons deemed to be a danger or nuisance to the vehicle, other passengers, or the chauffeur, and in such circumstances no compensation or refund shall be made to such persons.
  18. Full charges will be payable in the event of cancellation with less than 24 hours notice.
  19. Refunds are at the discretion of the management.
  20. These Terms and Conditions and the agreement between Top Calibre and the Client are governed by English law
